These Terms & Conditions (the “Terms”) are written to be clear and fair. They govern your access to and use of WeatherBoard, including the website at weatherboard.net, the application at app.weatherboard.net, all related subdomains, and any boards, overlays, feeds and services we provide (together, the “Service”). By creating an account, subscribing to a paid plan, or otherwise using the Service, you agree to these Terms.

1. The Service

WeatherBoard is a weather-graphics platform that turns public and licensed weather data into polished, broadcast-quality boards, streaming overlays and digital-signage displays for websites, livestreams and screens. Features available to you depend on the plan you choose, as described on our Pricing page.

What WeatherBoard sells. WeatherBoard sells access to hosted software — dashboards, streaming overlays, digital-signage controls, personal-weather-station integrations, alerts and weather-visualization tools — on a subscription basis. WeatherBoard does not sell weather or map data as standalone data, does not resell third-party content, does not operate an advertising or payment marketplace, and does not sell hardware.

2. Accounts & eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or purchase a subscription. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Please give us a heads-up at help [at] weatherboard.net if you think your account has been compromised — we’ll help you sort it out.

3. Plans, billing & payments

We try to keep billing simple, with prices shown up front and no hidden fees. WeatherBoard offers a free plan and paid subscription plans (currently Pro, Creator and Organization), plus custom Enterprise arrangements. Current prices and features are shown on the Pricing page and are stated in U.S. dollars.

• Subscriptions renew automatically. Paid plans are billed in advance on a recurring monthly basis and renew automatically until cancelled.
• Authorization. By subscribing, you authorize our payment processor to charge your payment method the then-current plan fee plus any applicable taxes each billing period.
• Price changes. Launch and founding-member prices are introductory and may change. We will give existing subscribers reasonable advance notice of any price change that affects their plan; changes take effect on the next billing period after notice.
• Failed payments. If a renewal payment fails, we or our payment processor may retry the charge and may suspend or downgrade paid features until payment succeeds.

4. Free plan & trials

The free plan is genuinely free, and the intention is to keep it useful. It is offered at no charge and may be subject to usage limits (for example, the number of boards, locations and the data-refresh interval shown on the Pricing page). As a small operation, we may need to modify, limit or discontinue the free plan over time. Any free trial of a paid plan, if offered, converts to a paid subscription at the end of the trial unless cancelled beforehand.

5. Cancellation & refunds

You may cancel a paid subscription at any time. When you cancel, your plan remains active through the end of the current billing period and then does not renew; we do not bill you again. Because WeatherBoard offers a free plan and live demos that let you fully evaluate the product before paying, all sales are final and payments are non-refundable, except where a refund is required by law or as described in our Refund Policy. 6. Acceptable use

WeatherBoard is run by one person on shared infrastructure, so a few firm rules keep it working, lawful, and fair for everyone. These are requirements, not requests. When using the Service, you must not:

• use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• resell, sublicense or redistribute the Service or its data feeds except as expressly permitted by your plan;
• extract, scrape or resell the underlying weather, radar or map data as standalone data, or use the Service as a substitute data API except where an API plan expressly permits it;
• remove, obscure or alter any attribution, source credit or disclaimer shown on the Service or in its outputs;
• present WeatherBoard output as an official government, National Weather Service or emergency-management product, or imply that WeatherBoard or any output is endorsed by or affiliated with NOAA, the NWS or any government body;
• use WeatherBoard Shout, signage or overlay features to operate an advertising or sponsorship marketplace, broker third-party ad sales, or display content you are not authorized to use — these features are for content you own or control, and you are responsible for it;
• attempt to gain unauthorized access to, disrupt, overload, or reverse-engineer the Service or its infrastructure;
• scrape, harvest or place automated load on the Service beyond your plan’s normal use;
• upload unlawful, infringing, deceptive or malicious content, or content you do not have the right to use.

7. Weather data & no-warranty on forecasts

WeatherBoard is meant to help you present and understand weather information more beautifully — not to replace official warnings, emergency instructions or your own judgment during dangerous conditions.

We do not warrant that any weather data is accurate, complete, current or uninterrupted.

8. Third-party data & services

The Service displays weather and map information drawn from public-domain, open-licensed and commercially licensed sources, which currently include the U.S. National Weather Service and NOAA (including NOAA NEXRAD radar), Open-Meteo, OpenStreetMap, OpenFreeMap, LibreWXR, and your own connected personal weather station. WeatherBoard uses these sources under their respective terms and preserves the attributions they require.

Derived visualizations, not official products. Government weather data (NOAA / NWS) is generally public-domain source material. The boards, overlays, radar scenes, alert styling and storm/lightning graphics WeatherBoard produces are WeatherBoard visualizations of that source data — they are not official government products, are not endorsed by and do not imply any affiliation with NOAA, the NWS or any government body, and may re-color, composite, smooth or annotate the underlying data.

Your plan grants you a license to use and display the Service’s outputs; it does not grant you any right in the underlying third-party data beyond what those providers’ licenses allow, and does not permit you to extract or redistribute that data as standalone data. Third-party data is subject to the providers’ terms and availability, and we are not responsible for third-party data, outages or changes.

9. Intellectual property

The Service, including its software, design, graphics, board layouts, and the “WeatherBoard” name and branding, is owned by the Operator and protected by intellectual-property laws. Subject to these Terms and your active plan, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service. We reserve all rights not expressly granted.

10. Your content

You retain ownership of the logos, names, station data, location choices and other content you add (“Your Content”). You grant us a license to host, process and display Your Content solely to operate and provide the Service to you. You are responsible for ensuring you have the rights to use Your Content and that it does not infringe others’ rights.

11. Disclaimers

We build and operate WeatherBoard with care, and we design the Service with reliability, security and accuracy in mind. That said, WeatherBoard depends on weather data, map data, radar feeds, third-party providers, networks, browsers, devices and infrastructure that may be delayed, unavailable, incomplete or incorrect. No online service or weather-data system can be guaranteed to be uninterrupted, secure, accurate or error-free.

For those reasons, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure, accurate, current or error-free.

12. Limitation of liability

We want WeatherBoard to be useful, reliable and worth what you pay for it. However, because the Service is subscription software that depends on live data, third-party services and internet delivery, we cannot accept unlimited liability for issues outside our control or for indirect losses.

To the maximum extent permitted by law, the Operator will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or relating to your use of, or inability to use, the Service. To the maximum extent permitted by law, the Operator’s total liability for any claim relating to the Service will not exceed the amount you paid for the Service in the twelve (12) months before the event giving rise to the claim.

13. Indemnification

If something you do with the Service, or content you add, leads to a claim from someone else, that needs to rest with you rather than with us. So you agree to indemnify and hold harmless the Operator from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms or any law or third-party right.

14. Suspension & termination

We’d much rather sort out a problem than cut anyone off — a quick email usually does it. That said, we may suspend or terminate your access to the Service if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to the Service. You may stop using the Service and close your account at any time. Provisions that by their nature should survive termination (including sections 9–13 and 16) will survive.

15. Changes to the Service or Terms

As a small product, WeatherBoard will keep evolving, so we may update the Service and these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Tennessee will have exclusive jurisdiction over disputes arising from these Terms, except where applicable consumer-protection law gives you the right to bring proceedings elsewhere. Nothing in these Terms limits the responsibilities of our payment processor as Merchant of Record for transactions it processes.
